Terms of Use
Last updated [DATE] · effective [DATE]
These are the terms of the agreement between you and [LEGAL ENTITY NAME] ("Memoira", "we", "us") for use of the Memoira app and website. By using Memoira you accept them.
The short version
- What you write is yours. We claim no ownership of it, ever.
- You may use Memoira for your own life story and those of people close to you.
- The companion is a writing aid, not a fact-checker — you are the author and the final word.
- If your subscription lapses, you keep everything you have written and can still export it.
Your account
You must be 16 or older to use Memoira. Keep your sign-in secure; you are responsible for what happens under your account. You can close it at any time from Settings, which deletes your content — so export anything you want to keep first.
Your writing belongs to you
You keep every right in the memories, text and photographs you put into Memoira. You grant us only the narrow permission needed to run the service for you: to store your content, to process it so the companion can help you write, to render it into the books you export, and to serve it to people you deliberately share a family link with. That permission exists to operate Memoira and for nothing else. It ends when you delete the content or your account.
We will not use your writing to train models, sell it, publish it, or show it to anyone you have not shared it with.
What you agree not to do
- Upload content you have no right to use, or that infringes someone else's rights.
- Use Memoira to harass, defame or endanger anyone.
- Attempt to break, overload or reverse-engineer the service, or use it through automated means at scale.
- Resell access to Memoira or use it to run a service for other people.
Writing honestly about real people in your own life is the entire point of a memoir, and nothing above is intended to prevent it. What we prohibit is using this tool as a weapon.
What the companion is, and is not
Memoira's companion suggests questions and drafts prose from what you tell it. It can misunderstand you, and it can produce text that is inaccurate or not what you meant. Nothing it writes becomes part of your book until you accept it. Please read what it gives you before you keep it — the book carries your name, not ours. Memoira does not provide legal, medical, financial or genealogical advice.
Subscriptions and payment
- Memoira begins with a free trial. You can write during the trial with no payment method on file.
- After the trial, continued use of the writing companion requires a paid subscription. Reading, editing and exporting what you have already written are never locked.
- Subscriptions bought on iOS are billed by Apple through your App Store account and renew automatically until you cancel. Cancel at least 24 hours before the period ends, in Settings → your name → Subscriptions on your device.
- Refunds for App Store purchases are handled by Apple under their policy, not by us.
- If we change the price, we will tell you before it applies to you.
If you stop paying
Your writing stays yours. If your subscription ends, your books remain in your account and you can still read them, edit them and export them in every available format. We will not hold your life story hostage to a payment. What stops is the companion's help with new writing.
Our service
We aim to keep Memoira available and working, but we cannot promise it will never be interrupted. We may change features over time; where a change removes something you depend on, we will give you notice and time to export. We may suspend an account that breaks these terms, and where it is reasonable to do so we will warn you first and give you a chance to retrieve your work.
The legal necessities
Memoira is provided "as is", without warranties of any kind to the fullest extent the law allows. To the extent permitted by law, our total liability to you for any claim relating to Memoira is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential losses. Nothing here limits liability that cannot lawfully be limited. Please keep your own copies of anything that matters to you — export your book from time to time. That is the honest advice, and it applies to every service, not only ours.
These terms are governed by the laws of [STATE / COUNTRY], and the courts of [JURISDICTION] have exclusive jurisdiction, except where your local consumer law gives you the right to bring a claim where you live.
Apple
Apple is not a party to these terms and has no responsibility for Memoira. Apple has no obligation to provide support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
If we change these terms materially, we will tell you in the app before the change takes effect. Continuing to use Memoira afterwards means you accept the new version.
